Terms and Conditions
	To be an authorized affiliate of Get The Dream, you agree to abide by the terms and conditions contained in this agreement: Get The Dream, LLC Affiliate Marketing Agreement This agreement describes the entire terms and conditions for participation in the Get The Dream, LLC Affiliate Marketing Program. In this agreement, the term "Affiliate" refers to all program applicants. Wherever the agreement refers to "you" or "your", it means "the Affiliate"; "we" or "our" refers to Get The Dream, LLC. Commissions and Payment You will receive 35% of the revenue as a commission from orders placed through your Affiliate link. For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered. Commissions will only be paid on sales which are made through qualified Affiliate links. If any order that generated a commission is returned by the customer, or if there are any returned payments or chargebacks, the amount will be deducted from the next payment due the affiliate. Pay periods end at 12:00:01 am Eastern Standard Time on the 1st of each month. Payments are sent within 15 days after the end of the pay period. US checks over $5,000 are sent at our expense by US Priority Mail wherever possible. US checks over $10,000 are sent overnight via FedEx wherever possible. Payment Threshold Twenty-five dollars is the Payment Threshold, or the minimum amount of money you must have in your account before we send payment. We hold your payment until your payable balance reaches this amount. Taxpayer ID Number Requirement for US Based affiliates Earning Over $600 U.S. based affiliate accounts earning over $600 per year are required to have a taxpayer ID number of some kind linked to their account, at a minimum a social security number. We highly encourage U.S. based affiliates earning over $600 a year to obtain an IRS issued Employer Identification Number (EIN). If you do not have one already, you may go to the IRS web site. This helps to simplify the year-end 1099 reporting requirement. The taxpayer ID number linked to your account must match the payee name on the account. If you are utilizing a business payee name but reporting under an individual social security number, you will need to mail a completed IRS W-9 form to us at: Get The Dream P.O. Box 1472 Mount Dora, FL 32757 If you are utilizing a U.S. address but are a beneficial resident of a foreign country, you will instead need to mail a completed IRS W-8ben form to us at the above address. Account Transfer At your request we can change the payee name associated with your account. To initiate this process we need a signed authorization statement from the current payee sent to us at Get The Dream, P.O. Box 1472, Mount Dora, FL 32757 via certified mail. A $10 account transfer fee applies. Account Closure You may close your account at any time. Any closing balance under $25 will be forfeited. To close your account we need a signed authorization statement from the current payee sent to us at Get The Dream, P.O. Box 1472, Mount Dora, FL 32757 via certified mail. Stale Checks Get The Dream, LLC affiliate checks are VOID after 90 days from the date of issue. Please present your checks to your financial institution promptly. If you present a check after the 90 days your bank may refuse the check. We can issue a new check if the stale check is in our possession. Please write "VOID" across the check and send it to the following address: Get The Dream, LLC. P.O. Box 1472 Mount Dora, FL 32757 After we receive the check a new one will be issued on the next payout date. Reissued Checks If your check is significantly delayed or lost you may request that we send you a new check. To issue a new check we have to pay a service fee to the bank to void the first check. A $20 cancellation charge applies. New checks will only be issued on the next payout date. Get The Dream, LLC must receive the reissue request by the 15th of the month in order for the check to be processed with the payment for the pay period ending the 1st. There are no exceptions to these deadlines. To request that a check be reissued, please send an email to affiliate@getthedream.com. Order Fulfillment Get The Dream, LLC will be solely responsible for processing every order placed by a customer on the Affiliate Site. You are not authorized to sell any of these products from your site as a "reseller" and no "resale" rights are granted in ANY way on these products unless otherwise noted. Returned Sales As part of our commitment to quality customer service, Get The Dream, LLC may approve a return in response to a customer dispute. When a sale is returned the customer receives a 100% refund and payouts from that sale are debited back out of the corresponding affiliate accounts. Returns and revoked sales are backdated 8 days for accounting purposes. For example, if a return is processed on the 7th of the current month, the debit is applied to the previous pay period. Revoked Sales A purchase is revoked if the customer's bank later claims the purchase was unfunded or fraudulent. In these instances we charge the affiliate $15 per credit card chargeback. These practices can help prevent revoked sales: 1. Remind the customer that your website, company or brand name will not appear on their credit card statement. Instead they will see the name of product merchant "Get The Dream". 2. Make it very easy for the customer to contact you for technical support. Visibly display your email address on the page so that they can write it down. If you have a business phone number, provide them with that too. 3. Let the customer know that Get The Dream, LLC will be happy to help them if there is any problem with their purchase. Customers Customers who purchase products and services through the Affiliate Program will be deemed to be customers of Get The Dream, LLC. Accordingly, all Get The Dream, LLC rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. Get The Dream, LLC policies will always determine the price paid by the customer. Qualification for Commissions Affiliates must have an active link from their website to their Affiliate link or a valid Promotional Code in order to qualify for commissions. Qualifying Sites Get The Dream, LLC reserves the right not to accept any applicant into the Affiliate Program for any reason. Websites that Do Not Qualify for the Get The Dream, LLC Affiliate Program include sites which: • promote sexually explicit materials • promote violence • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age • promote illegal activities • violate intellectual property rights • do not reflect favorably on the Get The Dream brand Unsolicited Commercial Email or SPAM Get The Dream, LLC in no way participates in mass unsolicited emailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the Get The Dream, LLC Affiliate Program, with no refunds. Also, those found to be spamming will be reported to the FTC and every other governing body we can find. Bottom line: If you SPAM you’re out and, based on the new SPAM laws, you will potentially face severe criminal and legal penalties! Relationship of Parties You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement. Determination of Affiliate The affiliate associated with any Get The Dream, LLC sale is determined by an automated customer tracking system. Any decision made by this system is final and not subject to petition or debate. Limitation of Liability We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement. Disclaimers We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate links will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. Any disputes between the parties to this agreement which involves interpretations of the terms of this agreement shall be submitted to arbitration under the rules of the American Arbitration Association, and the finding of the Arbitrator shall be binding on all parties. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. By signing up for the Get The Dream Affiliate Program, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement. Legal Limitations This document is not a warranty nor does it outline all legal rights possessed by Get The Dream, LLC.
